No more circumventing the rules. On February 1, a tightened law regarding the ban on Sunday trading entered into force. The opening of shops under the pretext of running postal services was therefore limited. According to the new regulations, only those outlets where postal activity will prevail will be open on non-commercial Sundays.

Recall that the Sunday trading ban has been in force since March 2018. However, there are some exceptions - they usually include Sundays before Christmas. The law also provides for exemptions from the application of provisions. It concerns, among other things, the possibility of refueling the car, as well as shopping at gas stations, stations, airports and ships (so that shopping malls would not be created around stations, a provision was introduced that it is only about trade in passenger service). In addition, we can buy flowers or sell them at festivals, sports and cultural events, agri-food wholesale markets and, among others, purchases of vegetables, fruits, raw milk. Bakeries, pastry shops, ice cream parlors, pharmacies, souvenir shops, devotional items and postal services may also be open. And it is the latter gap that is most often used by shop owners, and now even large supermarkets. More and more retail chains opened on days that were supposed to be free for employees of this sector - because you can pick up a shipment and do shopping there. In this way, various retail chains legally operated on non-commercial Sundays.

The "leaky law", however, has been sealed. The amendment to the Act on Restricting Trade on Sundays and Holidays and on Certain Other Days came into force on February 1. Only those outlets where postal activity is the predominant activity indicated in the application for entry in the national official register of entities of the national economy may open their doors to customers. It must also account for at least 40% of monthly retail sales revenue. Such a decision practically closed retail chains from operating on Sundays. At least in those cases where normal employees came to work. According to the amendment to the act, only the owner can stand behind the counter on non-commercial Sundays. The entrepreneur will also be able to take advantage of the free assistance of, among others, a spouse, children or siblings. However, these persons will not be able to be employees or employed in a given retail establishment.

For breaking the trade ban on Sundays, the penalty is from PLN 1,000 to PLN 100,000. PLN penalty, and in the case of persistent violation of the Act - the penalty of restriction of liberty.
