In "Facts after Facts" about surveillance of the Pegasus system, which she fell victim, was said on Tuesday by prosecutor Ewa Wrzosek.- What was sought after?I do not know.I know that it was illegal - she noted.The former head of the intelligence agency Grzegorz Małecki noticed that Pegasus can monitor "all our activity, also giving the opportunity to forecast man's behavior in a closer and further future".

The Citizen Lab Group operating at the University of Toronto confirmed that the patron Roman Giertych and prosecutor Ewa Wrzosek were under surveillance with the help of Pegasus software, which without the user's knowledge can read the data from the phone, records conversations or image from the camera.Researchers were unable to indicate who was exactly behind the spying, but it was emphasized that the only clients of the Pegasus company are government agencies.

In Tuesday's edition of "Facts after facts" the case was commented by prosecutor Wrzosek, as well as Colonel Grzegorz Małecki, former head of the Intelligence Agency.

Wrzosek: I can't imagine legal grounds to survey me

Wrzosek admitted that with the fact of being under surveillance she feels "terrible for two reasons": as a citizen, but also as a prosecutor.- It is really difficult for me to find any justification for this kind of actions taken by state services.Initially, I only had a suspicion that such a cyber attack on the part of state services was made.Now I have confirmation.Six times this year, such a rather powerful and aggressive attack on my phone was made - she described.

Wrzosek said that she did not know what the services could look for in her private and professional life.- This tool basically enables total surveillance, Pegasus gives access to all data contained in the phone, to all phone calls, SMSs, emails.It also serves, due to access to the microphone and camera, as a tool for surveillance almost twice four hours a day - she mentioned.

- What was sought after?I do not know.However, I know that this was an illegal action, because I can not imagine that any legal grounds were found to apply this tool towards me - she said.

Wrzosek said that in this case "the term may be one".- This is a crime that public officials have committed.

- there is a mechanism of so -called operational control.Is subject to a strict legal regulation, when specific services, as part of their competences and to the extent granted by law, may apply for an ordinance of operational control after obtaining the consent of the Court and under his control - she reminded.- There is no such knowledge of such knowledge, while the procedure for starting such control is strictly regulated.First of all, there must be a reasonable suspicion of committing a specific crime - she added.

She assured that she herself did not commit any crime.- The only circumstance that in my opinion could cause this kind of reactions from state services, is unfortunately my law allowed in the LEX Super Omnia Association, as well as professional activity, i.e. initiating proceedings in the case of so -called envelope elections (in May 2020 -red.) - she recognized.

The prosecutor noticed that "there are serious reservations and doubts about the legality of the use of Pegasus with us in the country".- The assumption is also that it can be used for the most serious terrorist crimes or organized crime.I do not see here in one row with people of this habit, with criminals - she said.

Małecki: Pegasus is an offensive intelligence tool

Grzegorz Małecki in the program called Pegasus a "offensive intelligence tool".- As offensive as you can imagine when it comes to intelligence, because it interferes almost totally attacked in this way, because nowadays the smartphone accompanies us twenty -four hours a day and monitors all our activity, also giving us all our activity, giving us all our activitythe possibility of forecasting man's behavior in the closer and further future - he said.

The colonel pointed out that the surveillance concerns "the content of the current, past and some sense of future, because our plans are also in our phones".- Remember that our all movements, all our activity in physical terms, places of stay, are fully and monitored on a regular basis - he said.

When asked if Polish services were behind surveillance, he replied that "it was only to be determined".- Everything indicates this, because it is hard to imagine that similar actions in relation to our lawyers, to the prosecutor and lawyer, were carried out by special services of other countries - said Małecki.

- If it were so, the Polish state authorities should clarify this matter - he noted.He added that in his opinion Pegasus "is absolutely not a tool that would have the right to use under criminal proceedings".
